The problem
In the Philippines, those who dare to stand up for human rights in the face of business- related abuses are paying a high price. Human rights defenders have been subjected to a range of attacks, from legal harassment to unjust imprisonment and in some cases, extrajudicial killings. Genuine and prompt access to remedy is essential to address these violations and ensure that human rights defenders are respected and protected, and to bring an end to impunity.

In 2023, GRC conducted a remote fact gathering mission into human rights violations committed against defenders of business-related human rights abuses in the Philippines. Working with impacted communities, the project specifically focused on the types of retaliation that defenders of business-related human rights abuses face when carrying out their work. The research focused on the national legal and political context in the Philippines, the types of industries most affected and how defenders could access remedy. Specifically, GRC focused on abuses committed in the mining and oil and gas industries which affected agricultural communities and indigenous groups. The fact gathering process included in-depth research, using various literature sources, including academic publications, reports from international organisations and local civil society organisations and case law of the Filipino courts.
